Terms and Conditions
The Online British School
“The Online British School” or “we” means The Online British School, a company registered in Hong Kong under the address 4a, Realfound Mansion, 30A Stanley Main Street, Hong Kong.
Payment and Booking
Payment must be paid upfront for all classes.
Once The Online British School has received payment the student’s place in the class is reserved, subject to clause 3 below.
Cancellations and Alterations
Fees are not refundable if a student cancels the class less than 12 hours before the class starts.
The Online British School reserves the right to cancel classes. In such circumstances a full refund will be given.
Timetables may be altered at any time at the sole discretion of The Online British School. If such alterations mean the course is no longer viable for the student at the sole discretion of The Online British School a refund will be offered.
When The Online British School is running the same classes for different ability levels The Online British School reserves the right to move children between the classes to ensure that children are in the most suitable class for their ability. Any such changes are at the sole discretion of The Online British School.
Apart from the refunds set out above, The Online British School will not be liable for any claims resulting from any cancellations including any direct or consequential damages.
Discipline
The Online British School reserves the right to exclude students from the class if their behaviour is consistently disruptive to the class.
If students are excluded for behavioural reasons no refund will be given. All decisions regarding refunds will be at the sole discretion of The Online British School and subject to no appeal whatsoever.
Liability
If you have a complaint against a tutor or against us, you must inform us of that complaint within 24 hours of the occurrence that gave rise to it by sending an email to admin@theonlinebritishschool.com.
We place tutors to teach classes in good faith and in the belief that he or she will perform to the best of his or her abilities. Any opinion expressed by a tutor is not necessarily an expression of the opinions of The Online British School.
Neither The Online British School nor any of its staff shall be liable to you for any loss, injury, damage, expense or delay incurred or suffered by you arising directly or indirectly from or in any way connected with the delivery of a class or with any failure by The Online British School to supply a class and, in particular, but without limitation to the foregoing, any such loss, injury, damage, expense or delay arising from or in any way connected with:
failure of a class to meet your requirements for all or any of the purposes for which it is required by you;
any act or omission of a tutor, whether wilful, negligent, fraudulent, dishonest, reckless or otherwise; and
any loss, injury, damage, expense or delay incurred or suffered by a tutor,
provided that nothing in this clause 5 shall exclude or restrict the liability of The Online British School to you for death or personal injury resulting from negligence or for fraudulent misrepresentation or in any other circumstances where liability may not be so limited under any applicable law.
General
These Terms set out the whole agreement between you and us for the supply of the classes.
A person who is not party to these Terms shall not have any rights under or in connection with them under the new Contracts (Rights of Third Parties) Ordinance, Cap. 623 (the "Ordinance") took effect from 1 January 2016 in Hong Kong.
If any part of these Terms and Conditions contravenes any relevant law, to the extent that such a provision is invalid or unenforceable, it shall be deemed to be removed and the remaining Terms and Conditions shall not be affected and will remain valid and enforceable.
Jurisdiction
These terms and any non-contractual obligations arising out of or in connection with them shall be governed by Hong Kong law and you hereby submit to the exclusive jurisdiction of the Hong KongCourts for the adjudication of any dispute in connection with these Terms and Conditions.
